These Display Advertising Terms ('Terms') govern the display advertising services provided by Woosh Property Limited ('Woosh', 'we', 'us') to advertisers, agencies, and partners ('Advertiser', 'you'). By purchasing or placing display advertising on our platform, you agree to these Terms.
II. Advertising Services
We offer various display advertising opportunities across our platform.
A. Available Ad Formats
Banner Ads: Standard IAB sizes including leaderboard, MPU, and skyscraper formats.
Native Ads: Content-style advertising that matches our platform design.
Sponsored Listings: Premium property placements with enhanced visibility.
Video Ads: Pre-roll and mid-roll video advertising opportunities.
Mobile Ads: Optimized formats for mobile app and mobile web.
B. Placement Options
Homepage placements for maximum visibility.
Category pages targeting specific property types.
Search results pages with contextual targeting.
Property detail pages for relevant audience reach.
Email newsletter sponsorship opportunities.
C. Targeting Capabilities
Geographic targeting by region, city, or postcode.
Demographic targeting including age, income, and family status.
Behavioral targeting based on search history and preferences.
Retargeting to reach previous website visitors.
Device and platform targeting options.
III. Campaign Requirements
All advertising campaigns must meet our standards and requirements.
A. Creative Specifications
All creative assets must meet our technical specifications for file format, size, and resolution. Advertisements must be clearly distinguishable as advertising content. Maximum file sizes: Banner ads 150KB, Rich media 2MB, Video ads 50MB.
B. Content Standards
Advertisements must be truthful, accurate, and not misleading. All claims must be substantiated. Content must be appropriate for all audiences. No discriminatory, offensive, or illegal content. Property advertisements must comply with all relevant regulations.
C. Prohibited Content
False or deceptive advertising.
Content that infringes intellectual property rights.
Malware, spyware, or harmful code.
Political advertising without prior approval.
Adult content or gambling services.
Illegal products or services.
IV. Booking and Payment
Terms for booking advertising space and payment obligations.
A. Booking Process
Advertising space is subject to availability. Bookings are confirmed upon receipt of signed insertion order. We reserve the right to reject any advertising at our discretion. Minimum campaign values may apply.
B. Payment Terms
Payment terms are net 30 days from invoice date unless otherwise agreed. Pre-payment may be required for new advertisers. Late payments incur interest at 2% per month. All prices are exclusive of VAT.
C. Cancellation Policy
Cancellations must be made in writing. Cancellations within 48 hours of campaign start incur 100% charge. Cancellations 48-72 hours before start incur 50% charge. No refunds for campaigns already commenced.
V. Performance and Reporting
We provide comprehensive reporting on campaign performance.
A. Standard Metrics
Impressions delivered and click-through rates.
Geographic and demographic breakdowns.
Device and platform performance.
Time-of-day and day-of-week analysis.
Custom conversion tracking where applicable.
B. Reporting Schedule
Real-time dashboard access for live campaigns.
Weekly performance summaries via email.
Monthly detailed reports with insights.
End-of-campaign comprehensive analysis.
C. Delivery Guarantees
We guarantee delivery of contracted impressions. Under-delivery will be compensated with additional impressions. No guarantee on click-through rates or conversions. Force majeure events exempt from guarantees.
VI. Intellectual Property
Rights and responsibilities regarding advertising content.
A. Advertiser Content
You retain ownership of your advertising content. You grant us license to display your advertisements. You warrant you have all necessary rights to the content. You indemnify us against any IP infringement claims.
B. Our Platform Rights
We retain all rights to our platform and technology. Advertising placement does not grant any rights to our IP. Our trademarks and branding remain our property.
VII. Data and Privacy
Use of data in display advertising must comply with privacy laws.
A. Data Usage
Targeting data is used solely for campaign delivery. No personal data is shared with advertisers without consent. All data usage complies with GDPR and privacy regulations.
B. Cookie Compliance
Advertising cookies require user consent. Third-party cookies must comply with our cookie policy. Advertisers must respect user privacy preferences.
VIII. Liability and Indemnity
Limitations of liability and indemnification provisions.
A. Limitation of Liability
Our liability is limited to the value of the advertising campaign. We are not liable for indirect or consequential damages. Technical issues may affect campaign delivery.
B. Advertiser Indemnity
You indemnify us against claims arising from your advertisements. This includes content claims, IP infringement, and regulatory violations. Indemnity survives termination of these Terms.
IX. Termination
Either party may terminate for material breach with 30 days written notice. We may terminate immediately for violation of content standards. Upon termination, all outstanding payments become due.
X. General Terms
These Terms are governed by English law. Disputes are subject to the exclusive jurisdiction of English courts. We may update these Terms with 30 days notice. These Terms constitute the entire agreement for display advertising services.
